Heard learned advocate for the parties and have argued the case for some time and it is submitted that the appeal being Regular Civil Appeal No. 35 of 2009 is pending before learned 4th Additional District Judge, Gondal, and nature of dispute involved in the said appeal require urgent hearing.

Considering the above, the learned Judge of the Appellate Court is to consider the appeal and decide it finally on or before 31.10.2012.

With the aforesaid direction, this petition is disposed of. Notice discharged.
