Heard Sri Dhirendra Kumar Srivastava, learned counsel for the petitioner, Sri Amrit Raj Chaurasia, learned A.G.A. and perused the impugned F.I.R. as well as material brought on record.
This petition has been filed by the petitioner with a prayer that suitable direction may be issued to the authority concerned for ensuring fair investigation of case crime no. 204 of 2017 under sections 147, 302, 201, 34 I.P.C., police station Badalpur, District Gautam Budh Nagar.
Learned counsel for the petitioner submitted that the petitioner is the informant of the case and though during the investigation final report was submitted but protest was filed by the petitioner. It is also submitted that vide order dated 20.7.2018 learned Chief Judicial Magistrate, Gautam Budh Nagar, has ordered for further investigation which is still pending.
From the perusal of the record it reveals that the petitioner is the first informant of the abovementioned case. In case the petitioner is having any grievance with regard to the investigation of the abovementioned case, the same may be raised before the S.S.P. Gautam Budh Nagar, who shall look into the matter so that fair and expeditious investigation of the abovementioned case may be ensured.
It is further directed that the S.S.P., Gautam Budh Nagar shall supervise the investigation and ensure that the same is completed speedly without any undue delay and police report be submitted before the court concerned expeditiously preferably within a period of two months from the date of production of a certified copy of this order before him.
With the above directions this petition is finally disposed of.
