Heard Sri Mohammad Umar Khan, learned counsel for the applicant and learned A.G.A. for the State.
Learned counsel for the applicant submits that applicant will be satisfied if a direction is issued to direct the courts below i.e. Additional Chief Judicial Magistrate-I, Gorakhpur to decide the Case No. 2624 of 2013 (Savita Singh Om Kailash Pati), under Section 138 N.I. Act, Police Station- Gorakhnath, District- Gorakhpur, pending before him within stipulated period.
This innocuous prayer is not opposed by learned A.G.A.
In view of such facts, this application can be disposed of with a direction to the Additional Chief Judicial Magistrate-I, Gorakhpur, to decide the pending case of the applicant on its own merits, referred to above, expeditiously, preferably within a period of six months from the date of receipt of certified copy of this order, strictly in accordance with law.
In above terms, the application is disposed off.
