JUDGMENT / ORDER

Heard Shri Anand Mani Tripathi, learned counsel for the petitioner, Shri Anurag Kumar Singh, learned counsel for the State Election Commission, Shri Raj Bux Singh, learned Additional Chief Standing Counsel and Shri Dhirendra Singh, Advocate, who submitted that he has filed Caveat on behalf of opposite party no.7.
On an objection raised by Shri Anurag Kumar Singh, learned counsel for the State Election Commission that the present writ petition under Article 226 of the Constitution of India is not maintainable as the petitioner has an alternative and statutory remedy under Section 12-C of the U.P. Panchayat Raj Act, learned counsel for the petitioner submitted that the writ petition may be dismissed as not pressed with liberty to avail appropriate remedy in accordance with law. To which there is no objection by the other side.
In view of above, the writ petition is dismissed as not pressed on the ground of availability of alternative and statutory remedy.
