Heard learned counsel for the parties.
By the instant writ petition, petitioner seeks a direction to the first respondent, Secretary, Bal Vikas Avam Pushtahar Vibhag, Government of U.P. Lucknow to consider and decide the departmental appeal filed by the petitioner on 28 February 2017 against the order imposing penalty.
Learned Standing Counsel submits that the appropriate orders shall be passed by the first respondent.
In regard thereto, without entering into the merit of the case, as well as, rival contentions raised by the respective parties, it is provided that the first respondent, Secretary, Bal Vikas Avam Pushtahar Vibhag, Government of U.P. Lucknow, shall pass appropriate orders, in accordance with Rules on the departmental appeal of the petitioner, expeditiously, preferably, within three months from the date of filing of certified copy of this order along with the copy of the writ petition.
With the aforementioned observations/directions, the writ petition stands disposed of.
