Heard learned counsel for the applicant, learned A.G.A. and perused the record.
This bail application has been moved by the applicant Savita Devi who is involved in Case Crime No. 163 of 2018, under Sections 323, 307, 506, 302 I.P.C., Police Station- Lar, District- Deoria.
As per prosecution version, on 21.07.2018 at about 08:00 P.M, applicant with co-accused Ravindra Yadav, Mintu Yadav and Parvati Devi committed murder of Lal Muni Devi.
Learned counsel for the applicant contended that there is single injury to the deceased Lal Muni Devi. The role of causing injury is assigned to Ravindra Yadav and role of catching hold is assigned to applicant and other co-accused. The first information report has been lodged with inordinate delay. Applicant has no criminal antecedents. Applicant has been falsely implicated in this case due to enmity.
Learned A.G.A. oppose the prayer for bail.
There is single injury to the deceased, due to which she died. Applicant is a lady. The first information report has been lodged on 24.07.2018 i.e., after three days of occurrence.
Considering the facts and circumstances of the case, I find it a fit case for enlarging the applicant on bail. Let the applicant- Savita Devi, be released on bail in the aforesaid case crime number on his furnishing a personal bond and two reliable sureties of the like amount to the satisfaction of the C.J.M./Magistrate, concerned.
Application stands allowed.
