Heard learned advocate Mr. D.M. Thakkar for the applicant. He submitted that pursuant to the agreement between the parties, advance payment was made for the goods to be supplied by the respondent accused but the respondent accused did not supply the goods and the cheque given by the respondent accused to the applicant towards security of value of the goods to be supplied was presented in the bank but it was dishonoured. Therefore, it was proved that the respondent accused gave cheque towards discharge of its liability.
In view of above, leave to appeal is granted. This application stands disposed of.
