Counter affidavit and rejoinder affidavit filed today are taken on record.
This transfer application has been filed praying for transferring the compliant case no. 1061 of 2017 (Smt. Alka Gupta Vs. Saurabh and others) pending in the court of Judicial Magistrate- IInd Varanasi to District Allahabad.
The ground for transferring the case is that father and mother of the applicant are old and aged and are confined to bed, therefore, applicant can not go to Varanasi.
Learned counsel for the opposite party no.2 submitted that applicant himself is residing at Pratapgarh therefor, there is no justification for transferring the case to Allahabad.
This application is disposed of with the direction to the Judicial Magistrate- IInd Varanasi to decide proceedings of the aforesaid case within a period of three months from the date of production of certified copy of this order before him.
