Heard Shri Madhup Narain Shukla, learned counsel for the petitioner and Shri Anurag Srivastava, learned Standing Counsel for the State respondent no.1.
Notice need not be issued to the private respondent nos.2 to 6, in view of the order proposed to be passed.
The petitioner is before this Court with request to issue direction to the first respondent, Assistant Collector/Sub Divisional Magistrate, Tehsil Harraiya, District Basti to decide the Appeal No.23/2016, Computerized Case No.20161714013464 (Shiv Bahadur Singh and others vs. Saurabh Singh and others) dated 10.6.2016 within stipulated time.
Learned counsel for the petitioner states that the proceedings under Section 34 of U.P. Land Revenue Act have been finalized in favour of the petitioner on 20.5.2016. Aggrieved with the aforesaid order, the private respondents have filed the aforesaid appeal on 10.6.2016 and the same is still pending.
Learned Standing Counsel fairly states that in case the aforesaid appeal is still pending and has not been disposed of, the same will be considered and decided expeditiously.
In view of the above, on consent and without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of finally with a direction to the first respondent to decide the aforesaid appeal after giving opportunity of hearing to the private respondent nos. 2 to 6, as expeditiously as possible and preferably within a period of six months from the date of production of a certified copy of this order before him, without granting unnecessary adjournments to either of the parties, except upon payment of cost of Rs.250/-.
