Heard learned counsel for the applicant, Sri J.K. Upadhyay, learned AGA for the State and perused the record.
This bail application under Section 439 of Code of Criminal Procedure has been filed by the applicant seeking enlargement on bail during trial in connection with Crime No. 769 of 2019, under Sections 420, 467, 468, 471, 507 I.P.C registered at Police Station, Kalyanpur, District Kanpur Nagar.
As per prosecution case, the applicant impersonated himself to be as Gorav Gangwar, who is an employee of Awas Vikas Parishad and then grabbed Rs. 1,80,000/-, Rs. 7,00,000/- cash and a cheque of Rs. 5,63,000/- from the aspiring persons, who wanted to purchase some land.
Learned counsel for the applicant submits that the complainant has not given details as to on what date, the said amount has been given. He further submits that the cheque was issued in the name of U.P. Housing Board and, therefore, question of keeping the money by the applicant does not arise. Lastly, it has been argued that the applicant is in jail since 18.8.2019, trial is likely to take some time for its final disposal and, therefore, he be released on bail.
On the other hand, State Counsel opposes the bail.
Considering the serious allegations against the applicant, I am not inclined to release the applicant on bail at this stage.
The bail application is, accordingly, rejected.
The applicant would be at liberty to revive his application after the evidence of main witnesses.
Trial Court is also directed to expedite the hearing.
