Heard Sri Vidya Kant Tripathi, learned counsel for the applicants and learned AGA for the State.
This application u/s 482 Cr.P.C. has been filed for quashing of impugned order issuing Non Bailable Warrant of arrest dated 8.1.2018 against the applicants in Criminal Case No.568 of 2014 arising out of Case Crime No.425 of 2014 under Sections 498 A, 323, 504, 506 IPC and 3/4 D. P. Act, P. S. Vindhyachal, District-Mirzapur.
The prayer for quashing of the impugned order is refused.
However, it is provided that if the applicants file an application for recalling of the non bailable warrant of arrest issued against them within a period of three weeks from today, the said application shall be considered and disposed of expeditiously in accordance with law. For a period of three weeks from today, no coercive action shall be taken against the applicants. However, in case, the applicants do not appear before the Court below within the aforesaid period, coercive action shall be taken against them.
It is further clarified that the present order has been passed only with regard to the accused on behalf of whom this application u/s 482 Cr.P.C. has been moved in this Court.
With the aforesaid observations, this application is finally disposed off.
