Heard counsel for the parties and perused the record.
The present petition has been filed by the petitioners for quashing the entire criminal proceedings including impugned charge sheet dated 04.04.2017 bearing charge sheet no.68 of 2017 in Criminal Case No.35590 of 2017 (State vs. Saurabh Maheshwari and others) arising out of Case Crime No.0150 of 2017, under Sections 498-A, 323, 504, 354, 506 I.P.C. & Section 3/4 D.P. Act, 1961, P.S. Brahmpuri, District Meerut.
Learned counsel for the parties submit that parties have already filed affidavit of compromise before the court below and the matter has been settled by compromise. They have also filed a petition-13-B of Hindu Marriage Act, 1955 for a mutual divorce.
It is also submitted that Smt. Himani Kothari (wife) had also received an amount of Rs.10,00,000/- as full and final settlement compensation from Saurabh Maheshwari petitioner no.1(husband).
In view therefore, since the parties have settled the matter, the entire criminal proceedings including impugned charge sheet dated 04.04.2017 bearing charge sheet no.68 of 2017 in Criminal Case No.35590 of 2017 (State vs. Saurabh Maheshwari and others) arising out of Case Crime No.0150 of 2017, under Sections 498-A, 323, 504, 354, 506 I.P.C. & Section 3/4 D.P. Act, 1961, P.S. Brahmpuri, District Meerut is quashed.
With the aforesaid, the present petition is allowed.
It is also expected that the parties shall get the matter under Section 13-B disposed of.
