This writ petition has been filed, inter alia, for the following relief:
"(i) Issue a writ, order or direction in the nature of certiorari to quash the notices/orders dated 26.07.2019 and 27.12.2018 passed by the Executive Engineer, Distribution Division Hamirpur, Dakshinanchal Vidyut Vitran, Nigam Ltd.i.e. respondent no.4 to their consequential effect, contained as Annexure nos.5 and 4 to this writ petition respectively.
(ii) Issue a writ, order or direction in the nature of mandamus directing the respondents i.e. authority concerned to pass an appropriate order for restore the electricity supply to the petitioner and also not to adopt any coercive measure against the petitioner."
Learned counsel for the petitioner after arguing the matter at length has confined his prayer to the extent that the petitioner may be permitted to make a fresh representation before the concerned authority in respect of his grievances with a direction to the concerned authority to decide the same within a stipulated period Heard learned counsel for the petitioner and Mr. Arvind Srivastava, learned counsel for the respondents and perused the record.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the case, this writ petition is finally disposed of with a direction to the petitioner to make a fresh representation before the Respondent No.4, Executive Engineer ventilating his grievances within three weeks from today along with a certified copy of this order enclosing therewith a copy of the writ petition and its entire Annexures and, if any such representation is made, the said authority shall consider and decide the same in accordance with law after examining the entire matter by a speaking and reasoned order preferably within three weeks from the date of receipt of the said representation.
For a period of six weeks from today or till the disposal of the representation, whichever is earlier, no coercive action shall be taken against the petitioner.
It is made clear that in case the petitioner does not file the representation within the stipulated period, as indicated herein above, the benefit given to the petitioner under this order shall cease to operate.
With the above observations, the writ petition stands disposed of.
