Heard learned counsel for the applicant as well as learned A.G.A.
By means of the present application, the prayer sought by the applicant is to quash the entire proceeding of Gangster Trial No.224 of 2012(State Vs. Satyendra Singh) arising out of case crime no.176 of 2008 under Section 2/3(1) of U.P. Gangster Act, Police Station-Bansdeeh Road, District-Ballia pending in the court of Additional Sessions Judge-Vth, Ballia.
The contention advanced by learned counsel for the applicant is that an application is being moved by the applicant who has been declared as Juvenile on 14.10.2009 and he has been bailed out by the court of competent jurisdiction. Presently, the matter is pending before Gangster Court, Ballia.
In the event, if the applicant moves an application before the court concerned, the same shall be decided strictly in accordance with law within a period of three weeks from the date of production of certified copy of this order.
For the period of three weeks from the date of production of certified copy of this order till its disposal, no coercive action shall be taken against the applicant in the aforementioned case.
With the aforesaid observations, the present application under Section 482 Cr.P.C. stands disposed of.
