Heard learned counsel for the petitioner. Learned Standing Counsel accepted notice on behalf of respondent No.1 and Sri Shravan Kumar Pandey, learned counsel for respondent No.2.
The petitioner has preferred the present writ petition with the prayer to issue a mandamus directing the respondent No.2/District Basic Education Officer, Auraiya to pay pension regularly to the petitioner as well as arrears of the pension from the date of retirement in terms of the Government Order dated 8.3.1978.
It is contended by learned counsel for the petitioner that in this regard a representation has already been made by the petitioner before respondent No.2 on 26.12.2018, copy of which is appended as Annexure No.3 to the writ petition. It is further argued that in spite of the fact that considerable time has already lapsed, but till date no decision has been taken on the same and prays that respondent No.2 be directed to decide the same expeditiously.
Heard learned counsel for the parties. With the consent of learned counsel for the parties, the matter is heard finally at the admission stage itself.
Considering the facts and circumstances of the case, without entering into the merits of the issue, the petitioner is permitted to submit a fresh representation ventilating all his grievances before respondent No.2/District Basic Education Officer, Auraiya along with certified copy of this order within a period for three weeks from today. In case any such representation is filed by petitioner within the period stipulated hereinabove before respondent No.2, the respondent No.2 will consider and decide the same as expeditiously as possible preferably within a period of three weeks from the date of filing of such representation by the petitioner before him.
With the aforesaid observations, the writ petition is disposed of.
