This Application has been filed seeking a direction to the learned Additional Chief Judicial Magistrate-III, Gorakhpur to expedite the proceedings of Criminal Case No. 2521 of 2017 'Satyendra Kumar vs. Saurabh Pandey' under Sections 419, 420, 406, 467, 468, 471, 504, 506 IPC P.S. Shahpur, District Gorakhpur.
The applicant is complainant. It is submitted that the crime is of the year 2016 and the case is of the year 2017. The proceedings are still very young and it is not known what is the priority of the cases before the Magistrate where the matter is pending. However, this Court is of opinion that a right to speedy trial of a person is guaranteed under Article 21 of the Constitution. It is also in the interest of complainant to put an end all proceedings commenced at his instance .
Looking to the nature of the matter, the Trial Court is directed to proceed with the case expeditiously and endeavour to conclude as early as possible bearing in mind the relative priority of the cases pending before him.
This Application is disposed of with the above orders.
