Heard learned counsel for the petitioner, learned Standing Counsel for the respondent nos. 1 and 2 and Sri Nisheeth Yadav, learned counsel for respondent no. 3.
Learned counsel for the petitioner submitted that after completing the Special B.T.C. Training Course in the year 2007-08. Pursuant to Government Order dated 14.11.2008, petitioner has appeared in Special B.T.C. Training Course in the year, 2016 and he has qualified the said examination. Thereafter, petitioner has also cleared the TET examination, but even though appointment letter has not been issued to them pursuant to the vacancy of 28,385 of Assistant Teachers in Junior Basic Schools. For redressal of his grievance, petitioner has moved representation dated 16.8.2019 before the respondents, but till date same has not been decided and no appointment letter has been issued to him. Lastly, he submitted that a suitable direction may be issued to the respondents to decide the representation of the petitioner dated 16.8.2019.
Learned counsel for the respondent no. 3 submitted that representation of the petitioner shall be considered and decided strictly in accordance with law.
Considering the facts and circumstances of the case, the writ petition is disposed of with liberty to the petitioner to move fresh representation before respondent no. 3 and in case any such representation is filed along with certified copy of this order, respondent no. 3 is directed to decide the same strictly in accordance with law maximum within three months from the date of production of certified copy of this order.
It is made clear that Court has not adjudicated the case on merits and it is upon the respondent no.3 to decide the representation of the petitioner after considering the relevant Rules as well as Government Order or any other law occupying the field.
