Order on Crl. Misc. Correction Application
Heard Mr. Ajay Kumar Srivastava, learned counsel for applicant and learned A.G.A. for State.
This correction application has been filed by applicant- Satyendra Kumar @ Satyendra, seeking correction in the prayer clause of application under Section 482 Cr.P.C. and consequently in the order dated 18.01.2021.
Learned counsel for applicant contends that due to inadvertence in the prayer clause of application under Section 482 Cr.P.C., the description of case number giving rise to application under Section 482 Cr.P.C. was wrongly transcribed as 230 of 2020, whereas the correct description is 243 of 2020. He further contends that one of the charging sections, namely, 354 I.P.C. has also been inadvertently transcribed in the prayer clause of application under Section 482 Cr.P.C. He therefore contends that applicant be permitted to correct the prayer clause of application under Section 482 Cr.P.C.
Prayer made for is bonafide. Accordingly, applicant is permitted to correct/amend the prayer clause of application under Section 482 Cr.P.C.
In view of above, order dated 18.01.2021 also stands correct.
Accordingly, it is hereby provided that in place of description "Case No.230 of 2020" as occurring in second line of third paragraph of order dated 18.01.2021, the description "Case No.243 of 2020" shall be read. Similarly, section 354 I.P.C. occurring in fourth line of third paragraph of order dated 18.01.2021 shall stand deleted.
This correction shall form part of earlier order dated 18.01.2021.
With the aforesaid directions, this correction application stands finally disposed of.
Since the order dated 18.01.2021 has been corrected today, the time period provided in the order dated 18.01.2021 is extended by ten days from today.
