JUDGMENT / ORDER

Learned counsel for the petitioner contends that the petitioner was given appointment as Assistant Teacher (Untrained) on compassionate grounds on the death of his mother in harness. Vide impugned order dated 30.6.2012 services of the petitioner have been terminated while holding that the petitioner was not eligible for being appointed in view of amendment in U.P. Basic Education Teacher Service Rules. The amendment has been made in view of the U.P. Right of Children to Free and Compulsory Education Rules, 2011. The petitioner has not passed T.E.T. Exam.
Learned counsel contends that if any such order was to be passed, principles of Natural Justice should have been observed.
Sri Anupam Shukla, Advocate, holding brief of Sri Prashant Arora, Advocate appearing for respondent nos.5 and 6, prays for time.
Let notices be served on respondent nos.2 and 3, returnable in four weeks.
Respondent nos.1 and 4 would be represented by State Counsel.
