Heard learned counsel for the petitioner and the learned Standing counsel for the respondents.
The petitioner has preferred this writ petition for a direction to the Sub-Divisional Magistrate to consider his applications dated 15.03.2019 and 10.06.2019 moved before respondent no. 3 SDM for restoration of the proper boundary marks which have allegedly been destroyed by respondents no.6 to 8.
The submission is that previously in proceedings under Section 24 of the U.P. Revenue Code, 2006 the boundary marks were affixed as per the order of the authority concerned but he has been destroyed by the private respondents.
Section 22 read with Section 23 of the Act obliges the Sub-Divisional Officer to ensure erection or restoration of proper boundary marks if they are destroyed.
In view of the aforesaid facts and circumstances, I dispose of the writ petition with the direction to the petitioner to move a fresh comprehensive application in this regard before respondent no. 3 within a period of two weeks from today and if any such application is filed along with the copy of this order, the aforesaid application and the earlier three applications as referred to above shall be considered and decided by respondent no.
3 in accordance with law most expeditiously, if possible, within a period of three months and the boundary marks shall be restored as per the above order.
The writ petition is disposed of.
