Heard Rajeev Chaddha learned counsel for the petitioner, the learned AGA and perused the record.
The limited relief claimed in this writ petition is that an appropriate direction be issued to respondent No. 1 to consider and dispose of the application filed by the petitioner under Section 433 Cr.P.C.
Learned AGA submits that no purpose would be served by keeping this petition pending, it may be disposed of by giving appropriate direction to the authority concerned.
The writ petition is 'disposed of' with a direction that in the event the petitioner files a certified copy of this order before respondent No. 1, the said respondent shall consider and dispose of the application (annexure-1 to the writ petition) as expeditiously as possible, in accordance with law, preferably within three months from the date of production of the same.
We clarify that we have not examined the merits of the claim of the petitioner.
