Heard Sri K.K. Mishra, holding brief of Sri Vikash Chandra Tiwari, learned counsel for the revisionist and Sri I.P. Srivastava, learned A.G.A for the State and perused the record.
This revision has been filed with the prayer for quashing the order dated 5.2.2018 passed by C.J.M. Kashganj in Misc. Case No.2359 of 2017, Case Crime No.275 of 2011, u/s 342, 504, 506, 182 IPC, P.S. Sahawar, district Kanshiram Nagar (Kasganj).
Learned counsel for the revisionist submits that FIR was lodged by one Naveen Kumar Sharma against opposite party no.2 in which final report was submitted but the revisionist along with two other persons is facing prosecution in the present case. The finding recorded by the court below is perverse, erroneous and bad in the eyes of law.
Learned AGA opposed the prayer for quashing of the impugned judgment and order passed by the court below.
After having heard the learned counsel for the parties present and perused the impugned order as well as the material brought on record, I am of the view that the impugned order is based upon relevant considerations and supported by cogent reasons, the same does not suffer from any irregularity, illegality or jurisdictional error, hence no interference is required by this Court. The prayer for quashing the impugned order is refused.
This revision lacks merits and is accordingly dismissed.
