1. Heard Sri Anand Pati Tiwari, learned counsel for applicant and learned A.G.A. for State.
2. The present bail application has been moved by accused- applicant for enlarging him on bail in Case Crime No.29 of 2016 under Sections 363, 376 IPC and Section 3/4 of Protection of Children from Sexual Offences Act, 2012, Police Station- Bela, District-Auraiya.
3. It is contended that applicant has been falsely implicated, but record shows that FIR version is not only corroborated by statement of Informant but also in the statement of victim/prosecutrix recorded under Section 161 Cr.P.C., she has clearly fortified the prosecution version implicating the accused-applicant of committing rape upon her. In her statement recorded under Section 164 Cr.P.C. before concerned Magistrate (Copy whereof is at Page 67 of Paper Book), the prosectrix has also corroborated the FIR version. I am also informed that trial is still going on and had not concluded.
4. Looking into entire facts and circumstances, I do not find it a fit case for grant of bail.
5. Application is, accordingly, dismissed.
