JUDGMENT / ORDER

Heard Shri Ranjeet K. Yadav, learned counsel for the petitioner and Shri M.P. Singh Gaur, who has filed caveat on behalf of the respondent no. 2. It has been submitted by the learned counsel for the petitioner that all the petitioners have been allotted wholly udan chak except petitioner no. 4 who has been allotted a chak including a small area of his original plot no. 64. It has further been submitted that the case of the petitioner has not been considered by the Deputy Director of Consolidation while passing the impugned order. Matter requires consideration.
Shri Singh, who has filed caveat on behalf of respondent no. 2, prays for and is granted two weeks time to file counter affidavit. Learned counsel for the petitioner will have two weeks thereafter to file rejoinder affidavit. Issue notice to respondent nos 3 to 12 by registered post A.D. Steps may be taken within ten days.
List on the date fixed on the notice.
Until further orders, the effect and operation of the impugned order dated 19.6.2014 shall remain stayed. It is further provided that the parties shall ensure that no damage is caused to the tube well of the respondent no. 2 which is said to be existing in plot no. 506. Order Date :- 25.7.2014 Priyanka
