Heard learned counsel for the applicant and learned A.G.A. for the State.
This application under Section 482 Cr.P.C. has been filed for a direction upon the Court below to conclude the trial of Sessions Trial No. 278 of 2016 arising out of Case Crime No. 408 of 2015, under Sections 323, 325, 504, 506 I.P.C. and Section 3(1)(10) of S.C./S.T. Act, Police Station- Achhalda, District- Auraiya pending in the court of Special Judge (F.T.C.- I), Auraiya.
It is submitted by learned counsel for the applicant that trial is pending since 2015. It is further submitted that applicant has been falsely implicated in the present case and he has to join service on 29.03.2019 and the witness are being examined.
Considering the facts and circumstances of the case, it is provided that the Court below shall proceed to conclude the above mentioned trial within a period of three months from the date of presentation of certified copy of this order.
With the aforesaid direction, the application is finally disposed of.
