Heard learned counsel for the petitioner and Sri Lakshmi Kant Mishra learned counsel on behalf of respondents.
The petitioner claims to be the highest bidder in the auction held on 6.3.2021 with respect to shop no.133, Super Market, Krishak Bazar, Saharanpur.
The order impugned records that the bid offered by the petitioner had not been accepted and the demand draft of the registration fee had been returned to the petitioner.
Submission of learned counsel for the petitioner is that before the cancellation of bid no opportunity of hearing has been granted to the petitioner and once the petitioner had been declared successful as highest bidder it was not open for the respondent to cancel to allotment.
Both these contentions of the learned counsel for the petitioner are found devoid of merits, in as much as, by offering the bid no indefeasible right has been conferred upon the petitioner, to get the allotment. As the highest bid according to the petitioner which was Rs.9,10,000/-, had not been found suitable by the competent authority, we do not find any reason to entertain the writ petition.
For the grievances raised herein, however, the petitioner may approach the Director, Krishi Utpadan Mandi Samiti by invoking provisions of Section 32 of Krishi Utpadan Mandi Adhiniyam 1964.
