Heard learned counsel for the parties.
Learned Standing Counsel on instructions submits that the prayer of the petitioner for grant of Assured Career Progression (ACP) has been rejected.
In view thereof, the writ petition is dismissed, insofar it relates to prayer clause no. 1 with liberty to the petitioner to take remedy against the order rejecting his claim of A.C.P.
Instant writ petition is confined to prayer clause no. 2, which reads thus:
"issue a writ, order or direction in the nature of mandamus directing the the respondents to pay the arrears of suspension allowance to the petitioner pending from the period of 11.6.2008 to 6.4.2009."
Learned Standing Counsel submits that the third respondent shall consider and decide the claim of the petitioner expeditiously.
In regard thereto, without entering into the merit of the case, as well as, rival contentions raised by the respective parties, it is provided that the third respondent, Deputy Commandant General, (Home Guard), Home Guard Head Quarter, U.P. Lucknow, shall consider and decide the claim/representation of the petitioner, by a reasoned and speaking order, expeditiously, preferably, within six weeks from the date of filing of certified copy of this order along with the copy of the writ petition.
With the aforementioned observations/directions, the writ petition stands disposed of.
