Heard learned counsel for the petitioner and Sri Vikram Bahadur Yadav learned Standing Counsel.
The petitioner has instituted this petition for the consideration of his candidature for appointment as a Constable.
This claim was based and rested on an OBC certificate which stands appended at page-16 of the paperbook. As is evident from the certificate, the same had been issued for persons applying for appointment to posts under the Government of India. In view thereof the petitioner's candidature has rightly not been attended to by the State respondents. The position as stated is in accord with the principles enunciated by the Full Bench of the Court in Gaurav Sharma Vs. State of U.P. And Others 2017 (5) ADJ 494]. The reliance placed by learned counsel for the petitioner on an order passed in Ravish Kumar Bharti Vs. State of U.P. And 3 Others [ 2018(9) ADJ 295] does not take the case of the petitioner any further since Ravish Kumar Bharti related to a case of a Scheduled Caste candidate. The position in respect of OBCs is clearly distinct and different. The petition lacks merit and is dismissed.
