This Habeas Corpus Writ Petition has been registered on the basis of telegram sent by one Ram Kumar Shukla alleging therein that his son Satya Prakash Shukla has been lifted from his house by the police personnel of police station Thakurganj, Lucknow without any rhyme or reason and it is apprehended that he may be implicated in some false case.
Counter affidavit of Sri Rajeev Krishna, DIG/SSP., Lucknow has been filed denying the allegations made in the telegram and in reply thereto it has been stated that said Satya Prakash Shukla is one of the accused in case crime No. 250 of 2010 under Sections 406 & 506 IPC read with Section 3 (1) X of the SC/ST Act of Police Station Thakurganj, Lucknow as such, he was apprehended in the night intervening 10th & 11th April 2010 at about 01.00 am after assigning due reasons. He was produced before the learned Magistrate concerned on 11th April 2010 who remanded him to judicial custody and he was sent to jail and at present he is detained in District Jail, Lucknow.
In view of what has been said in the uncontroverted counter affidavit, the writ petition is misconceived and is accordingly dismissed.
