JUDGMENT / ORDER

Writ petitioner - appellant, aggrieved by an order dated 21.12.2009 passed by learned Single Judge in Civil Misc. Writ Petition No.62732 of 2009, has preferred this appeal under Rule 5 Chapter VIII of the Allahabad High Court Rules, 1952.
Writ petitioner - appellant, aggrieved by an order of suspension dated 02.11.2009, has preferred the writ application. The learned Single Judge by the impugned order refused to interfere with the order of suspension.
Mr. Gyanendra Srivastava, learned Counsel appearing on behalf of the writ petitioner - appellant submits that the allegation made against the writ petitioner - appellant is not sustainable and therefore, the order of suspension is fit to be set aside.
We are afraid that present proceeding is not an appropriate proceeding to go into the truthfulness or otherwise of the allegation made as it is always a subject matter of enquiry.
We are of the opinion that the consideration of the matter by the learned Single Judge does not suffer from any error, calling for interference in this appeal.
Appeal stands dismissed.
