Heard learned counsel for the petitioner.
In view of the order proposed to be passed, notices need not be issued to the respondents.
The petitioner has preferred the present petition under Article 227 of the Constitution of India with the prayer to direct the Civil Judge (Junior Division) City Azamgarh to decide the injunction application being Paper No.7C2 filed in Original Suit No.502 of 2020 (Chandrabhan Vs. Satyaprakash and another) expeditiously.
It is argued by learned counsel for the petitioner that the petitioner is the defendant in the aforesaid suit. It is argued that an ex-parte interim injunction has been granted in favour of the respondent-plaintiff by the trial Court vide its order dated 06.07.2020. It is argued that the petitioner has filed objection to the aforesaid application but till date no final order has been passed on the same. It is argued that the next date fixed in the matter is 08.09.2021.
In the facts and circumstances of the case and without entering into merits of the case, the present petition, under Article 227 of the Constitution of India, is disposed of directing the Court below to pass appropriate orders on the aforesaid application being Paper No.7-C2 filed by the respondent/plaintiff expeditiously and preferably on the next date fixed, i.e., on 08.09.2021. In case, on the said date on account of any reason, the said application could not decide on the said, the court below will decide the same expeditiously and preferably within a period of six weeks thereafter.
