JUDGMENT / ORDER

Heard Sri Manish Mani Sharma, learned counsel for the petitioner and the learned Standing Counsel appearing on behalf of the opposite parties.
The present Writ Petition has been filed seeking a direction to the opposite parties to treat the petitioner as a Government servant from the initial date of appointment of the petitioner in view of the law laid down by Hon'ble the Supreme Court in the case of State of U.P. v. Chandra Prakash Pandey and others (Civil Appeal no.8467 of 1995).
A further direction to count the 38 years of petitioner's services for payment of pension and other service benefits, as has been paid to other Kurk Amins, has also been made.
To the aforesaid effect, learned counsel for the petitioner has already submitted a representation. At present, learned counsel for the petitioner restricts his prayer for a decision on the same.
Looking to the innocuous prayer being made by learned counsel for the petitioner and without entering into the merits of the case, the opposite party no.1, i.e. the Principal Secretary to the State of U.P., Department of Co-operative, Lucknow is directed to take a decision on the representation submitted by the petitioner, by a reasoned and speaking order, within a period of six weeks from the date a copy of this order along with a fresh representation is produced before him.
In view of the aforesaid observations, the writ petition stands disposed of.
