Heard Sri Harendra Yadav, learned Counsel for the petitoner, learned Standing Counsel for the State respondents, Sri Bhupendra Kumar Tripathi, learned Counsel for the respondent no.5, Gaon Sabha and perused the record.
The instant writ petition under Article 226 of the Constitution of India has been filed for the following relief:-
"(I) issue a writ, order or direction in the nature of mandamus directing the respondent no.2 to enforce the order dated 14.12.2020 passed in Case No.00466 of 2020 (Satya Narayan Vs. Gaon Sabha), under Section 21/24 of U.P. Revenue Code, 2006 and fix pillar on spot."
Learned Standing Counsel on the basis of instructions received submits that the order dated 14.12.2020 passed by the respondent no.2, Sub-Divisional Officer, Kasimabad, Ghazipur has already been implemented at the spot.
Learned Counsel for the petitioner admitted the said position and submits that under these circumstances the writ petition has become infructuous and is liable to be dismissed as such.
The prayer is accepted.
The writ petition is, accordingly, dismissed as having become infructuous. Copy of the instructions along with a copy of the order is kept on record.
