Petitioner is a Public Prosecutor, he was posted at Allahabad and was allotted Official House No. T-III/67 A.P.O. Colony Police Line Allahabad. Petitioner has now been transferred to Varanasi on 21.07.2017. However, he has not vacated the official accommodation which has been allotted to one Sri Shyamdhar Dwivedi another Prosecuting Officer who has been posted at Allahabad. On account of the allotment of the aforesaid house to another person, petitioner is being pressurized to vacate the same. We do not find any illegality on the part of the authorities in insisting for vacating the house.
The submission of the petitioner is that his children are studying at Allahabad and their examination are to be held in the month of February and March 2018, therefore, he may be accommodated till the end of the March. The petitioner for the above purpose has moved a representation to the SSP Allahabad through the Joint Director of Prosecution, Varanasi.
In view of the above, we dismiss the writ petition, but with the observation that SSP Allahabad may consider the aforesaid representation, if presented before him or after calling it from the Joint Director of Prosecution, Varanasi within a period of two weeks from the date of production of the copy of this order.
