Heard learned counsel for the petitioner, learned Standing Counsel for the respondents no.1 & 2. Sri Bhanu Pratap Singh, learned counsel for the respondent nos.3 to 5.
The petitioner is working as Headmaster in Junior Basic School, Amuda Mohiuddihnpur, Block Mohammadpur, District Azamgarh.
It appears that certain disciplinary proceedings have been initiated against the petitioner and after enquiry, an order dated 02.12.2019 has been passed by the respondent no.3-District Basic Education Officer, Azamgarh imposing punishment of stoppage of two increments. By the said order the petitioner was reverted to the post of Assistant Teacher and was directed to join in Uchcha Prathmik Vidyalaya, Chauki Deogaon, Shiksha Kshetra, Lalganj, District Azamgarh. The said order is impugned in the writ petition.
Learned Standing Counsel submits that against the order impugned, there is statutory remedy of appeal under Rule 5 of The Uttar Pradesh Basic Educational Staff Rules, 1973.
Since against the order impugned, there is statutory alternative remedy available to the petitioner, therefore, the writ petition is dismissed on the ground of alternative remedy.
