JUDGMENT / ORDER

Heard Sri Sameer Kalia, learned counsel for the petitioner and Sri B.L. Verma for opposite party no. 1.
The case of the petitioner is that she was working with U.P. State Mineral Development Corporation Ltd. prior to her joining in the Bank-opposite party no. 1. The petitioner is claiming the benefit of selection grade and time scale in the bank. On the basis of her past service which she has rendered in the U.P. State Mineral Development Corporation Ltd.
Sri B.L. Verma appearing for opposite party no.1 has drawn attention of this Court towards absorption order dated 21.01.2000 as contained in Annexure No. 10 to the writ petition, wherein four conditions were laid down in the absorption order. These conditions were accepted by the petitioner. Clause (iv) of the said conditions clearly states that all the service benefits will be payable to the petitioner from the date of her absorption in the Bank. Vide Annexure No. 11, the petitioner has filed declaration that she has terminated her lien with the earlier department, therefore, the petitioner is not entitled for any relief on the basis of her past service. He prays for and is granted four weeks' time to file counter affidavit. Rejoinder affidavit, if any, may be filed within a week, thereafter.
