Heard learned counsel for the petitioners; learned A.G.A. for respondents 1, 2 and 3; and perused the record.
The instant petition seeks quashing of the First Information Report dated 21.9.2018 registered as Case Crime No. 0263 of 2018, under Sections 323, 504, 354B, 506 I.P.C., at Police Station - Nidhauli Kalan, District - Etah.
The impugned First Information Report reveals that the accused persons, namely, the petitioners were assaulting Ajay, a neighbour, when the informant (the victim) raised objection, they assaulted her and tore her clothes as well and have insulted her.
As the F.I.R., discloses commission of cognizable offence, no case to quash the F.I.R., is made out. Further, the defence of the petitioners that they have been falsely implicated is not to be considered at this stage, particularly when the matter is under investigation. The petition is dismissed.
