Learned APP Mr. Pandya waives service of notice of rule on behalf of opponent - State Authority in all matters.
2. The applicant seeks modification of order dated 12th July, 2004 passed in Criminal Miscellaneous Application No.5781 of 2003 to 5792 of 2003 and 5794 of 2003, whereunder, while being released on bail, he was required to surrender his passport, if any, with the lower Court.
3. According to the applicant, he has surrendered his passport and now, that passport has expired. The applicant needs passport for getting it renewed and therefore, he prays for necessary modification in the order, particularly, Condition (h), imposed by the Court in the common order in question.
4. In facts and circumstances of the case, the applications are allowed. The trial Court concerned is directed to return the passport to the applicant for the purpose of getting the same renewed. Again, the applicant shall surrender the passport upon being renewed or upon issuance of a fresh passport by the Passport Authority as the case may be. The applicant shall abide by other conditions imposed by this Court by order dated 12th July, 2004 (supra).
5. Rule is made absolute accordingly in all applications. Direct service is permitted.
