Heard learned counsel for the applicant and the learned Additional Government Advocate appearing on behalf of the State/opposite party no.1.
This application under section 482 Cr.P.C. has been filed seeking direction to the Additional Chief Judicial Magistrate- IInd, Gautam Budh Nagar to decide Criminal Case No.2383 of 2015 (State vs. Gauran and others) arising out of Case Crime No.32 of 2014, under Sections 498-A, 323 IPC, Police Station Badalpur, district Gautam Budh Nagar, pending in the court of Additional Chief Judicial Magistrate-IInd Gautam Budh Nagar expeditiously.
Having regard to the facts and circumstances of the case and having considered the submissions made by the learned counsel for the applicant, the Chief Judicial Magistrate-IInd, Gautam Budh Nagar is directed to decide the aforesaid case expeditiously, preferably within a period of nine months fixing short dates, if there is no legal impediment.
It is further directed that the parties shall cooperate in the proceeding and no unnecessary adjournment will be sought/granted.
With the above observations, the application stands disposed of.
