Heard Sri Atul Pandey, learned counsel for the petitioner and Sri K.M. Asthana, learned counsel for the respondent-Bank.
The petitioner had taken a loan for a sum of Rs. 9,58,000/- and another loan of Rs. 2,99,000/- for agricultural purposes and third loan of Rs. 46,000/- for purchasing a motor-cycle.
The petitioner defaulted in payment and, therefore, now a recovery certificate has been issued for combined amount of Rs. 13,05,727/- by the HDFC Bank. At this stage, learned counsel for the petitioner submits that the petitioner accepts the liability and he is ready to pay the entire outstanding amount provided this Court fixes some easy instalments.
Learned counsel for the respondent-Bank has no objection, if the petitioner stricts with the time scheduled for payment fixed by this Court.
In view of the aforesaid facts and circumstances, the writ petition is disposed of with the direction that the petitioner will deposit an amount of Rs. 1 lac within one month from today. Upon depositing the amount of Rs. 1 lac, the Bank will issue statement of account to petitioner and the petitioner will, thereafter, deposit the remainder amount in three equal three monthly installments.
In case of any default, the bank will be at liberty to proceed against the petitioner and the petition may be treated to be dismissed automatically.
