Heard learned counsel for the parties.
Petitioner came to be selected on the post of Constable pursuant to Recruitment-2015. It appears from the material brought on record that the matter is pending before the seventh respondent-Superintendent of Police, Etah/appointing authority as is evident from the communication dated 30 November 2018 issued by the Superintendent of Police, Kanpur Dehat.
By the instant writ petition, petitioner seeks following relief:
i) issue a writ, order or direction in the nature of mandamus commanding the respondent no. 7, Senior Superintendent of Police, Etah, to take a decision on merit with regard to the appointment of the petitioner for the post of Police Constable and Constable PAC (Male) Direct Recruitment- 2015, in pursuance of the Hon'ble High Court order dated 19/09/2018 passed in Writ Petition No. 20111/2018 & 04/01/2019.
Learned Standing Counsel submits that the first respondent-Principal Secretary, Home, U.P. Shashan, Lucknow, shall pass appropriate order, in accordance with law.
In view thereof, on consent, the petition is disposed of directing the first respondent-Principal Secretary, Home, U.P. Shashan, Lucknow, to consider and decide the representation of the petitioner by reasoned and speaking order, expeditiously, preferably within a period of six weeks from the date of filing of certified copy of this order alongwith copy of the writ petition.
It is clarified that the Court has not considered the claim of the petitioner on merits.
