Heard the learned counsel for the revisionists and the learned A.G.A. of the State.
The instant criminal revision has been preferred against the order dated 23.11.2018 passed by the learned Judicial Magistrate, Budhana, Muzaffar Nagar in Case No. 291/9 of 2014 whereby the discharge application has been rejected.
It is submitted by the learned counsel for the revisionists that the application moved by the revisionists claiming discharge pursuant to the order passed by this court on 13.3.2018 in Application U/s. 482 No. 7680 of 2018 has been rejected by the court below in a very cursory manner when prima facie no offence is made out against the revisionists.
The learned A.G.A. has pointed out that without surrendering before the court below the revisionists have moved the discharge application, which has rightly been rejected by the court below. It has been conceded by the learned counsel for the revisionists that the charges have already been framed against the revisionists.
In this view of the matter, the revision cannot be entertained to quash the order passed by the court below. The learned counsel has failed to point out any infirmity in the order impugned hence does not call for any interference.
The revision is accordingly dismissed.
