By order dated 13.9.2018 Standing Counsel appearing for Nagar Nigam, Allahabad was directed to take instructions in the matter. The written instruction supplied today is taken on record.
Sri Shyam Mani Shukla appearing for respondents-2 and 3 on the basis of written instructions informs that in pursuance of judgment of Supreme Court in Uttar Pradesh Power Corporation Ltd. Vs. Rajesh Kumar and others: (2012) 7 SCC, 1 promotion earlier done in the reservation quota has been cancelled. Thereafter 4 posts for promotion has fallen vacant in the category of Class III. By notification dated 30.8.2017 applications were invited for promotion from amongst the eligible employees in which 22 applications from class IV employees have been found correct. The Selection Committee has finalized the selection list relating to promotion and forwarded it for approval to General Manager of Nagar Nigam through letter dated 23.12.2017. Till today approval has not been obtained as such the names of the candidates have not been disclosed.
In the facts of the case since proceeding for promotion has already been taken as such writ petition is disposed of giving liberty to the petitioner if he feels aggrieved he may make a suitable representation to General Manager (respondent-2) who shall decide it after three months from the date of receipt of representation in accordance with law.
