Heard learned counsel for the petitioner and learned Additional Government Advocate.
Under challenge in this writ petition is FIR relating to crime no. 148 of 2010 under Sections 420 & 406 IPC of Police Station Vikas Nagar, district Lucknow.
We have gone through the contents of the FIR. The FIR discloses commission of cognizable offence, as such, the same cannot be quashed.
However, considering the allegations levelled in the FIR, which seem to be trivial in nature, we direct that unless and until cogent and reliable evidence comes forward against the petitioner, the petitioner shall not be arrested in the above mentioned case crime number, provided he cooperates with the investigation, which shall go on.
The writ petition is finally disposed of.
