This anticipatory bail application u/s 438 Cr.P.C. has been moved seeking the bail of applicant namely Satish Kumar, in the event of his arrest in Case Crime No.713 of 2019, under Section 3/7 Essential Commodity Act, Police Station Bana Devi, District Aligarh.
Heard learned counsel for the applicant and learned A.G.A. for the State and perused the record.
Counsel for the applicant has not been able to point out any such aspect which may persuade this Court to lean favourably towards the accused. The kind of criminal activity in which the applicant is said to have been indulged adversely affects the public supply system and the genuine consumers are cheated. Unlicensed illegitimate refiling of cylinders has become a crime on massive scale which is destroying the legitimate gas supply mechanism. Even a large scale of erosion and short fuelling of gas as a result of such illegitimate refiling of cylinders is also likely to take place.
After considering the submissions advanced on behalf of rival sides, the nature and gravity of the accusation and the material in support of the same, I find no good ground for grant of anticipatory bail to the applicant.
Accordingly, the anticipatory bail application is rejected.
It is clarified that the observations, if any, made in this order are strictly confined to the disposal of the bail application and must not be construed to have any reflection on the ultimate merits of the case.
