Supplementary affidavit filed today is taken on record. The petitioner has made following prayer:-
"(i) issue a writ, order or direction in the nature of mandamus commanding and directing the respondents to make an enquiry with regard to the illegalities committed by Manager and Principal separately or jointly with regard to embezzlement of funds of the institution in question namely, Janta Inter College, Nagal, District Saharanpur, through any independent agency.
(ii) issue a writ, order or direction in the nature of mandamus commanding and directing the respondents authorities to restrain Manager and Principal of the institution, Janta Inter College, Nagal, District Saharanpur, not to withdraw any amount from any account of the institution without permission of the District Inspector of Schools, Saharanpur."
The writ petition does not disclose any material particulars of embezzlement. Merely because some person has withdrawn some cash from the Bank account of the institution does not satisfy the ingredients of embezzlement to warrant an enquiry by the Court.
The writ petition is dismissed.
