Heard Shri Nisar Uddin, learned counsel for the petitioner, Shri S.M. Shukla, learned counsel for the respondents no.2 & 4 and the learned Standing Counsel for the respondents no.1 & 3.
The petitioner in the writ petition is seeking quashing of the order dated 23.02.2017 whereby he is stated to have been dismissed from service.
Shri S.M. Shukla, counsel for the respondents no.2 & 4 is not able to point out to the Court whether against this order of dismissal any departmental appeal lies under rules or not. It is unfortunate that the counsel is not able to provide any assistance to the Court.
Learned Standing Counsel, on the other hand, submitted that against the order of dismissal appeal lies before the Commissioner.
In this view of the matter, the writ petition is dismissed. The petitioner may avail his departmental remedy of appeal.
