Heard learned counsel for the petitioners, learned Standing Counsel appearing for the State- respondents and Sri Rajesh Yadav, learned counsel appearing for the Gaon Sabha-respondent no.5.
Proceedings under Section 122-B of the U.P. Zamindari Abolition & Land Reforms Act were initiated against the petitioners for ejectment which has been challenged by the petitioner in appeal, which is stated to be pending before the Collector. In the meantime, it is submitted that the Gram Panchayat has initiated proceedings to auction the trees standing on the plot, as claimed by the petitioners to be their trees. In case, such an appeal is pending, the petitioners may move an application for stay before the appellate authority. In case, such an application is moved, the same be considered and decided without unnecessary delay.
With the aforesaid observation/direction, the writ petition stands finally disposed of.
