Heard Mr. Pankaj Mishra learned counsel for the applicant and the learned A.G.A. for the State.
At the very outset learned counsel for the applicant submits that the due to inadvertence there some mistakes in the prayer clause of the present application have been crept in. He therefore submits that he be permitted to amend the prayer clause of the present application. Prayer made for is allowed.
This application under section 482 Cr. P. C. has been filed challenging the summoning order dated 25.01.2017 passed by the Special Judge, SC/ST Act, Etawah, in Complaint Case No. 04 of 2016 (Satish vs. Krishan Murari Singh Yadav and others), under sections 323, 504 IPC, and Section 3 (1) (r) (s) SC/ST Act, Police Station Asrahar, District Etawah. Apart from above, the applicant has also challenged the order dated 9.3.2018 passed in the aforesaid complaint case pending in the Court of Special Judge, SC/ST Act, (P.A.) Act/Additional Sessions Judge Etawah.
The Court finds that the complainant himself has failed to comply with the order passed by the Court below. Consequently the Court below dismissed the complaint case filed by the applicant in terms of Section 204 (4) of Cr.P.C. This Court does not find any illegality in the order dated 9.3.2018 passed by the Court below.
The application fails and is, accordingly, dismissed.
