Heard learned counsel for the petitioners and perused the record.
In view of the order proposed to be passed, notices need not issue to the respondents.
The petitioners are before this Court for a direction to court below i.e. Civil Judge ( Junior Division) City, Varanasi to decide the 6C application dated 30.04.2019 filed by the plaintiffs/ respondent, within stipulated period.
An ex-parte interim order was granted in favour of plaintiff respondent on 30.04.2019. A stay vacation application has been filed by the present petitioner before the court below on 04.07.2019, which was numbered as application no.6C. It is argued that though large number of dates were fixed but till date no decision has been taken on the aforesaid application.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the court below i.e. Civil Judge ( Junior Division) City, Varanasi to consider and decide the aforesaid application in accordance with law expeditiously and preferably within a period of four months from the date of production of self attested computer generated copy of this order downloaded from the official website of High Court Allahabad but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, if there is no legal impediment.
